We guarantee your divorce application will be lodged within two (2) working days of receiving all the information and documentation required, including your signed application. We also guarantee there will not be any nasty surprises in relation to costs.  We believe in being transparent from start to finish.

The fixed fee quote includes our professional fees and outlays (out of pocket costs) based on your responses to the quote questions.  These outlays include the filing fee charged by the Court, process server fees (if applicable) and other necessary costs such as translation fees (if applicable).  These costs are passed on to you without any mark up meaning we only charge what it costs us for these expenses.

Once you pay the amount detailed in our quote, provided the circumstances notified in the quote process do not change, there are no further costs or charges.  During the course of applying for your divorce, if we become aware of anything which contradicts the basis for our quote, we will cease work and immediately contact you to discuss it further before any additional costs are incurred.

You and your spouse need to be separated for a period of twelve (12) months before you can apply for a divorce.

Once you complete our divorce questionnaire and provide supporting documentation required, including your signed application, we guarantee to lodge your application for divorce within two (2) working days.  Once lodged with the Court we will be notified of a hearing date. The time frame may vary, depending on how busy the Court Registry is at the time.  At the moment, the current turnaround for a hearing date is approximately 5 months from the date of lodgement.

The Court will consider your application at the hearing and if approved, a Divorce Order will be made, effective one (1) month and one (1) day after the hearing date.

  1. You will not need to appear at the Court hearing unless you are making a sole application and there are children of the marriage under the age of 18. This not only includes children of you and your spouse but also includes children who were treated as members of your family prior to your final separation for example a step-child or foster child.

If you make your Application for Divorce through Amicus Family Law, we will appear at the Divorce Hearing with you.

If you are unable to contact or locate your spouse you can apply for an order to dispense with service or for substituted service.

It is possible for you and your spouse to be separated but to continue living in the same home during the 12 months before applying for divorce. This is known as ‘separation under the one roof’.  If this is the case for you, you need to prove to the Court that you were separated during this time.

Amicus Family Law can assist you in this process.

To apply for a divorce Order you must have been separated for at least 12 months. However, you can get back together for up to 3 months during this time without restarting the 12-month separation period.

If your reconciliation lasts any longer than 3 months then you will have to wait until 12 months from that date of separation to apply for a divorce Order.

Yes, as long as you or your spouse are either:

    1. An Australian citizen by birth or descent;
    2. Have been granted an Australian citizenship; or
    3. Be lawfully present in Australia and intend to continue living in Australia.  To meet this criteria, you must have been living in Australia for at least the last 12 months.

You can remarry as soon as your Divorce becomes final, which is one month and one day after the hearing of your Divorce Application.

If you apply for a sole application for divorce you are required to serve the Application on your spouse. Service is a requirement to allow your spouse to be notified of the pending application for divorce involving them.

If this is required in your case, we will engage a professional process server to serve the required documents on your spouse.

Please set aside 30 – 60 minutes to complete the questionnaire.  Whilst you can save your responses and return to the questionnaire at any time we suggest you have all the information and documentation required on hand when you start.

We want the divorce process to be as easy and pain free as possible. We suggest you start collating the following documents as soon as possible, as we cannot lodge your Application without them:

  • A copy of your marriage certificate;
  • If you were not born in Australia, a copy of your passport or citizenship documents;
  • A copy of any Court Orders in relation to your children or property settlement;
  • A copy of any Domestic Violence Orders that are in place, if any;
